Terms and Conditions

These Terms and Conditions govern access to and use of the website fabricadosorriso.pt (the "Site") by any visitor. By accessing or using the Site you confirm that you have read, understood and accepted these Terms and Conditions and our Privacy Policy.

Use of the Site implies full and unreserved acceptance of these Terms and Conditions. If you do not agree with any of these provisions, please leave the Site and refrain from using it.

Changes to the Terms

Fábrica do Sorriso — Clínica Dentária reserves the right to change the content of the Site, the services it presents and these Terms and Conditions at any time and without prior notice. Visitors are advised to review this page periodically.

Continued use of the Site after such changes are published constitutes implicit acceptance of the updated terms.

Access to the Site

Access to the Site is free of charge and does not require registration. Some features — notably the contact form — depend on personal data being voluntarily provided.

Fábrica do Sorriso — Clínica Dentária may, at any time and without notice, suspend, restrict or close access to the Site, in whole or in part, including for maintenance, security or technical reorganisation, without any obligation to compensate visitors.

Use of the Site

You agree to use the Site responsibly, lawfully and respectfully. In particular, you agree not to:

  • Publish, transmit or make available content that is unlawful, false, misleading, defamatory, obscene, violent or that infringes third-party rights;
  • Introduce viruses, malicious code or any mechanism that may damage, overload or compromise the operation of the Site;
  • Use the Site for unauthorised commercial purposes, prospecting, mass data collection or unsolicited messaging (spam);
  • Impersonate another person, entity or member of the clinic team;
  • Attempt to access restricted areas or internal clinic systems without express authorisation.

Intellectual Property Rights

All elements that make up the Site — including text, images, video, logos, trademarks, icons, source code and overall structure — are the property of Fábrica do Sorriso — Clínica Dentária or of third parties that have licensed their use, and are protected under Portuguese and European copyright and industrial property law.

Any reproduction, copying, distribution, modification, public transmission, decompilation or commercial use of the Site's content, in whole or in part, without prior written authorisation from the clinic is expressly prohibited. Browsing the Site does not grant any licence or right over its content.

Personal Data

Filling in the contact form is voluntary. Any personal data collected is processed in strict compliance with the General Data Protection Regulation (Regulation EU 2016/679) and Portuguese Law no. 58/2019, solely to respond to enquiries, schedule appointments or follow up on complaints.

Information

The content published on the Site is for general information only. It is intended to introduce the clinic, the team, the services and treatments offered. It does not replace an in-person consultation, a clinical diagnosis or personalised medical advice.

Any clinical decision should be made only after evaluation by a qualified healthcare professional.

Liability and Warranties

Fábrica do Sorriso — Clínica Dentária takes reasonable care to ensure that the information published on the Site is accurate, up to date and clear, but does not warrant that it is free from errors, omissions or temporary inconsistencies.

To the maximum extent permitted by law, the clinic shall not be liable for any direct or indirect damages, loss of profit or loss of opportunity arising from the access to, use of or inability to use the Site, or from reliance on information published here.

The Site may include third-party content (for example, maps, videos or reviews), for which the clinic cannot be held responsible.

Appointment Booking and Cancellations

Appointments made through the Site's online booking system are confirmed the moment you validate the code sent to your e-mail address, within the available slots shown. The clinic may contact you to reschedule if the clinical team or the necessary equipment becomes unavailable.

Enquiries sent through the contact form are not bookings: they are requests for information, answered by the front desk by phone or e-mail.

Cancellations or changes should be notified at least 24 hours in advance. Repeated no-shows without justification may affect future bookings or, where communicated to the patient, give rise to a charge for the missed consultation.

Links to Third-Party Sites

The Site may contain links to external websites provided for visitor convenience. These sites are operated by third parties; the clinic does not control, endorse or take responsibility for their content, policies or practices. Accessing third-party sites is at the visitor's sole responsibility.

Security

The clinic adopts reasonable technical and organisational measures to protect the Site and the data transmitted through it. It cannot, however, guarantee in absolute terms that the Site will be free from interruptions, errors, viruses or other harmful elements beyond its control.

Access to certain features may be temporarily restricted to safeguard the security of the systems or of patients.

Severability

If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, void or unenforceable, the remaining provisions shall continue in full force and effect.

Governing Law and Jurisdiction

These Terms and Conditions are governed by Portuguese law. Any dispute arising from the use of the Site shall be submitted to the exclusive jurisdiction of the courts of the District of Lisbon, with express waiver of any other.
